Astute design rights holders don’t just—or even primarily—look to the courts to enforce their rights and protect their products. Industrial design rights provide other ways to keep infringers at bay. And many of these ways are cheaper, faster, and unavailable to utility patents.

  • Takedown requests in online marketplaces. Many online marketplaces like Amazon or Alibaba will remove listings that infringe an issued design right. Hear from Jack Schecter at Nike about ways they leverage this ability to stem the flow of infringing goods.
  • Customs Seizures. Many countries will seize goods at their borders on the basis of an issued industrial design right. We’ll show you some examples that highlight the opportunities and challenges that come from using your design rights in this way.
